(بخلاف مبادرته) أي: بعض الورثة (إلى ملك الميت) ودفنه فيه، فإنه ينقل بطلب باقيهم (لانتقاله) أي: الملك (إليهم) وفي إبقائه إسقاط لحقهم من التصرف فيه (لكن يكره لهم) نقله؛ لما فيه من هتك حرمته.
