(و) يحرم دفن (في ملك غيره) بلا إذن ربه؛ للعدوان (وللمالك إلزام دافنه بنقله) ليفرغ له ملكه عما شغله به بغير حق (والأولى) للمالك (تركه) أي: الميت، حتى يبلى؛ لما فيه من هتك حرمته. وكرهه أبو المعالي لذلك.
