(ولو أتلفه) أي: أتلف المالك النصابَ بعد وجوب الزكاة (لزمه ما وجب في التالف) وهو قدر زكاته (لا قيمته) أي: النصاب، كما لو قتل السيد عبده الجاني، وكان أرش الجناية دون قيمته،
