(وإن فعله) أي: القطع قبل بدو الصلاح (فرارًا من الزكاة، أثم ولزمته) الزكاة؛ لتفويته الواجب بعد انعقاد سببه، أشبه القاتل والمطلِّق ثلاثًا في مرض موته.
