(إلّا أن يدعيه) أي: التلف (بجائحة ظاهرة تظهر عادة) كحريق وجراد (فلا بد من بينة) تشهد بوجود ذلك الظاهر (ثم يصدق) المالك (في قدر التالف) من المال المزكى بلا يمين.
