(وإن ادّعى) رب الزروع أو الثمار (تلفها) بغير تفريط (قُبل قوله بغير يمين) نصّ عليه ؛ لأنّه خالص حق الله، فلا يستحلف عليه، كالصلاة. (ولو اتُّهم) في دعواه التلف
