(ويجوز لأهل الذمة شراء أرض عشرية من مسلم) لأنها مال مسلم يجب الحق فيه لأهل الزكاة، فلم يمنع الذمي من شرائه (كـ) الأرض (الخراجية) فللذمي شراؤها من مسلم، إذا حكم به من يراه أو كان الشراء من الإمام
