(وإن أُعطيَ مالًا ليفرقه، جاز) له (أخذه) لذلك (و) جاز له (عدمه) أي: عدم الأخذ (والأولى: العمل بما فيه المصلحة) من أخذ وعدمه، وحسَّن أحمد عدم الأخذ في رواية ، وكان لا يعدل بالسلامة شيئًا.
