(فإن تعذرت النفقة) على الزوجة الفقيرة أو الفقير أو المسكين (من زوج، أو قريب، بغيبة، أو امتناع، أو غيره، كمن غُصب ماله، أو تعطَّل منافع عقاره، جاز) لهم (الأخذ) لوجود المقتضي مع عدم المانع.
