(وإن أكل، ونحوه، شاكًّا في غروب الشمس، ودام شكُّه) قضى؛ لأن الأصل بقاء النهار.
و (لا) يقضي إن أكل ونحوه (ظانًّا) غروبَ الشمس، ولم يتبين له الحال؛ لأن الأصل براءته.
