(وإن لم يكن) في الارتفاق بها (ضَررٌ، جازَ الارتفاقُ بحريمها) لأن الحقَّ فيها لعامة المسلمين (ولا يُعتبر فيه إذنُ السلطان) ولا نائبه، للحرج.
