(وإلا) أي: وإن لم يكن حفر البئر بحقٍّ، كحفرها بطريق ضيق ونحوه (ضَمِنَ) ما تلف بها من الصيد (كالآدمي إذا تلف في هذه المسألة) قال ابن عقيل: لو باع فخًّا أو شبكة منصوبتين، فوقع فيهما صيد في الحرم، أو مملوكًا للغير، لم يسقط عنه ضمانه، ذكره عنه في "القواعد الفقهية".
