(وإن احتاج) المحرم (إلى فِعْل محظور، فله فِعله، وعليه الفداء) لأنَّ كعبًا لما احتاج إلى الحَلق، أباحه الشارع له، وأوجب عليه الفدية ، والباقي في معناه، ولأن أكل الصيد إتلاف، فوجب ضمانه، كما لو اضطر إلى طعام غيره. فصل
