(وإذا استأجر مسلم أرضًا من حربي، ثم استولى عليها المسلمون، فهي غنيمة) كسائر أراضي أهل الحرب (ومنافعها للمستأجر) إلى انقضاء مدة الإجارة؛ لأنها مالُ مسلمٍ معصومٍ.
