(وإذا أسلم رقيقُ الحربي وخرج إلينا) أي: إلى جيش المسلمين (فهو حُرٌّ) لحديث ابن عباس قال: "كان رسولُ الله - صلى الله عليه وسلم - يعتق العبيدَ إذا جاؤوا قبل مواليهِم" رواه سعيد . ولا ولاء عليه لأحد، كما يُعلم من كلامه في "الاختيارات" في العتق.
