(وإن لم يكن له) أي: للمأخوذ من مباح دار الحرب (قيمةٌ (٣) كالأقلام والمِسَنِّ) بكسر الميم (والأدوية، فهو لآخذه) ولو وصل إليه بقوة الجيش (ولو صار له قيمة بنقله ومعالجته) لأن ذلك أمر طارئ.
