(وعليه مهرُها يُطرح في المَقْسم) لأنها ليست مملوكة له، أشبه وطء أَمَة الغير، ولا يسقط عنه من المهر بقَدْر ملكه، كالمشتركة، خلافًا للقاضي؛ لأن مقدار حقه يعسر العلم به، ولا ضرر عليه بوضع المهر في الغنيمة، فيعود إليه حقّه
