(ومن وطئ جاريةً من المغنم قبل قَسْمِه ممن له فيها حق أو لولده، أُدِّب) لأنه وطء حرام؛ لكونه في ملك مشترك (ولم يبلغ به الحدّ) لأن له في الغنيمة ملكًا، أو شُبهة ملك، فيُدرأ عنه الحدُّ للشُّبهة
