(فإن كان العبد تالفًا، فعلى الحربي قيمته) فرَّط فيه أو لم يُفرِّط؛ لأن فاسد العقود كصحيحها في الضمان وعدمه، كما يأتي. (ويترادَّان) أي: البائع والمشتري (الفضل) أي: الزائد، فيسقط من الأكثر بقدر الأقل، ويرجع ربّ الزائد به إن كان.
