(فيحكُمُ) لأحدهما على الآخر إن شاء، (ويَعِدُ (٢) بطلب أحدهما) إحضار الآخر إن شاء؛ لما تقدم. (وفي المُسْتأمِنَينِ باتفاقهما) فإن أبى أحدهما، لم يحكم؛ لعدم التزامهما حكمنا، بخلاف الذِّميين.
