(ولا) بيع (خمر ولو كانا) أي: المتبايعان (ذِميين) لحديث جابر: سمعت رسول الله - صلى الله عليه وسلم - يقول: "إنَّ الله ورسولهُ حرَّمَ بيعَ الخمرِ والميتةِ والخنزيرِ والأصنامِ" متفق عليه (٤) .
