(ومطلق البيع) أي: إذا باع الحامل، ولم يتعرض للحمل، فالعقد (يشمله تبعًا) لأُمه إن كان مالكها متحدًا، وإلا، بطل، قاله في "شرح المنتهى" (كالبيض واللبن) قياسًا على أُسِّ الحائط، ويغتفر في التبعية ما لا يغتفر في الاستقلال.
