(إلا أن يَعتِقَ) العبد المسلم (عليه) أي: على الكافر المشتري له (بملكه) إيَّاه، لقرابة أو تعليق، فيصحُّ الشراء؛ لأن ملكه لا يستقر عليه؛ ولأنه وسيلة إلى تحصيل حرية المسلم.
