(ولا يَصحُّ بَيْعُ عبدٍ مسلمٍ لكافر) لأنه يُمنع من استدامة الملك عليه؛ فمُنع من ابتدائه كالنكاح (ولو كان) الكافر (وكيلًا لمسلم) في شراء العبد المسلم، لم يصحَّ؛ لأنه لا يصح أن يشتريه لنفسه، فلم يصحَّ أن يتوكَّل فيه
