(فإن رأيا) أي المتبايعان، وهما في مجلس التبايع (سَبُعًا أو ظالمًا خشياه، فهربا فزعًا منه، أو حملهما) من مجلس التبايع (سَيْلٌ، أو فرقتهما ريحٌ، فكإكراهٍ، قاله ابن عقيل) فيثبت لهما الخِيار إلى أن يتفرَّقا من مجلس زال فيه ذلك؛ لأن فعل المُلْجأ غير منسوب إليه.
