أو الأخيار لأحدهما بمفرده أو أسقطه أو قاله لصاحبه أختر سقط وبقي خيار صاحبه

(أو) تبايعا على أن (لا خيارَ لأحدهما بمفرده، أو أسقطه) أحدُهما وحده (أو قال لصاحبه: اخْتَرْ، سقط) خياره لظاهر الخبر السابق (وبقي خيار صاحبه) لأنه خيار في البيع، فلم يبطل حق من لم يسقطه كخيار الشرط. (ويبطل خيارُهما بموتِ أحدِهما) لأنها أعظم الفُرقتين.
