(وإن شَرَطه) أي: الخِيار (إلى طلوع الشمس، أو إلى غروبها، صحَّ) الشرط؛ لأنَّه أَمَدٌ معلوم (كتعليق طلاقٍ وعِتقٍ عليهما) أي: على غروب الشمس وطلوعها.
