(وإن قال:) بشرط الخيار (له) أي: لزيد (دُوني؛ لم يصحَّ) الشرط؛ لأن الخيار شُرع لتحصيل الحظ لكلِّ واحد من المتعاقدين، فلا يصح جعلُه لمن لا حظ له فيه.
