(ولو كان المبيع عبدًا) أو أَمَةً (فشَرَط) أحد المتعاقدين (الخيارَ له، صح) الشرط (سواء شَرَطه له البائع، أو المشتري) أو كلٌّ منهما، ويكون للمشترط أَصالة، وللمبيع توكيلًا منه، كما تقدم في الأجنبي.
