(وإن شَرَطه) الوكيل (لنفسه دون موكِّله) لم يصح الشرط، كما لو شرطه أحد المتعاقدين لأجنبي دونه (أو) شرطه الوكيل (لأجنبي؛ لم يصحَّ) الشرط.

وظاهره: ولو لم يقل: دُوني؛ لأن الوكيل ليس له أن يوكِّل في مثل ذلك.
