(وإن شَرَطا) أي: المتعاقدان (الخيار لأحدهما) من بائع أو مشتر (أو) شَرَطاه (لهما، ولو متفاوتًا) بأن شرطاه للبائع يومًا وللمشتري يومين مثلًا (صح) وكان على ما شرطا؛ لأنه حق لهما جُوِّز رفقًا يهما، فكيفما تراضيا به جاز.
