(ولمن له الخيار الفسخُ من غير حضور صاحبِه ولا رضاه) لأن الفسخ على حَلِّ عقد جُعِل إليه، فجاز مع غيبة صاحبه وسخطه، كالطلاق (أطلقه الأصحاب، وعنه) في رواية أبي طالب : إنما يملك الفسخ
