قَالَ: (وَإِذَا رَجَعَ شُهُودُ الْفَرْعِ ضَمِنُوا) لِأَنَّ التَّلَفَ أُضِيفَ إِلَيْهِمْ فَإِنَّهُمُ الَّذِينَ أَلْجَئُوا الْقَاضِي إِلَى الْحُكْمِ.
