(وَلَوْ قَالَ: مَاتَ الْمُودِعُ وَتَرَكَهَا مِيرَاثًا لَهُ وَصَدَّقَهُ أُمِرَ بِالدَّفْعِ إِلَيْهِ) ؛ لِأَنَّهُ لَمَّا صَدَّقَهُ عَلَى الْمَوْتِ فَقَدِ انْتَقَلَ مَالُهُ إِلَى وَارِثِهِ،

فَإِذَا صَدَّقَهُ أَنَّهُ الْوَارِثُ لَا وَارِثَ لَهُ غَيْرُهُ تَعَيَّنَ مَالِكًا فَيُؤْمَرُ بِالدَّفْعِ إِلَيْهِ.
