(وَلَوِ ادَّعَى الشِّرَاءَ مِنَ الْمُودِعِ وَصَدَّقَهُ لَمْ يَدْفَعْهَا إِلَيْهِ) لِأَنَّهُ مَهْمَا كَانَ حَيًّا فَمِلْكُهُ بَاقٍ فَلَا يُصَدَّقَانِ عَلَيْهِ فِي انْتِقَالِهِ بِالْبَيْعِ وَلَا بِغَيْرِهِ.
