قَالَ: (فَإِنْ جَاءَ صَاحِبُهَا فَلَهُ حَبْسُهَا حَتَّى يُعْطِيَهُ النَّفَقَةَ) ; لِأَنَّهُ اسْتَفَادَ الْمِلْكَ مِنْ جِهَتِهِ لِأَنَّهُ صَارَ هَالِكًا مَعْنًى وَقَدْ أَحْيَاهُ بِنَفَقَتِهِ فَصَارَ كَالْبَائِعِ
