(وَإِنْ كَانَ جَانِيًا فَعَلَى مَوْلَاهُ إِنْ فَدَاهُ، وَعَلَى وَلِيِّ الْجِنَايَةِ إِنْ أَعْطَاهُ لَهُ) ; لِأَنَّ مَنْفَعَتَهُ لِمَنْ يَسْتَقِرُّ الْمِلْكُ لَهُ وَالْجُعْلُ يَتْبَعُ الْمَنْفَعَتَيْنِ.
