الاختيار لتعليل المختارal-Mawsili

(وَيَجُوزُ أَنْ يَتَزَوَّجَ أَمَةً مَعَ الْقُدْرَةِ عَلَى الْحُرَّةِ) ؛ لِأَنَّ النُّصُوصَ لَا تُفَصِّلُ، وَهِيَ قَوْله تَعَالَى:{وَأُحِلَّ لَكُمْ مَا وَرَاءَ ذَلِكُمْ} ، وَقَوْلُهُ سُبْحَانَهُ:{فَانْكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ} ، وَغَيْرُ ذَلِكَ.
