الاختيار لتعليل المختارal-Mawsili

(وَ) الْمُحَرَّمَاتُ بِتَعَلُّقِ حَقِّ الْغَيْرِ فَـ (لَا يَجُوزُ أَنْ يَتَزَوَّجَ زَوْجَةَ الْغَيْرِ وَلَا مُعْتَدَّتَهُ) ، قَالَ - عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ -: «مَلْعُونٌ مَنْ سَقَى مَاءَهَ زَرْعَ غَيْرِهِ» ، وَلِأَنَّ ذَلِكَ يُفْضِي إِلَى اشْتِبَاهِ الْأَنْسَابِ. وَلِهَذَا لَمْ يُشْرَعِ الْجَمْعُ بَيْنَ الزَّوْجَيْنِ فِي امْرَأَةٍ وَاحِدَةٍ فِي دِينٍ مِنَ الْأَدْيَانِ.
