(وَإِنْ أَرَادَ التَّحْرِيمَ أَوْ لَمْ يُرِدْ شَيْئًا فَهُوَ إِيلَاءٌ) لِأَنَّ تَحْرِيمَ الْحَلَالِ يَمِينٌ، هَذَا هُوَ الْأَصْلُ وَمَوْضِعُهُ كِتَابُ الْأَيْمَانِ، وَالْمُتَأَخِّرُونَ مِنْ أَصْحَابِنَا صَرَفُوا لَفْظَةَ التَّحْرِيمِ إِلَى الطَّلَاقِ حَتَّى قَالُوا: يَقَعُ بِغَيْرِ نِيَّةٍ، وَأَلْحَقُوهُ بِالصَّرِيحِ لِكَثْرَةِ الِاسْتِعْمَالِ فِيهِ وَالْعُرْفِ.
