(ثُمَّ إِنْ كَانَ لَا يَسْتَضِرُّ بِهِ أَحَدٌ جَازَ لَهُ الِانْتِفَاعُ بِهِ) ؛ لِأَنَّ لَهُ فِيهِ حَقَّ الْمُرُورِ وَلَا ضَرَرَ فِيهِ فَيَجُوزُ.
