قَالَ: (وَإِنْ كَانَ عَبْدَهُ أَوْ مُكَاتَبَهُ لَمْ يُجْزِهِ) لِأَنَّهُ لَمْ يَخْرُجْ عَنْ مِلْكِهِ خُرُوجًا صَحِيحًا، وَهَذَا بِالْإِجْمَاعِ.
