(وَإِنْ عَقَدَهَا لِغَيْرِهِ لَمْ تَنْفَسِخْ) كَالْوَصِيِّ وَالْوَلِيِّ وَقَيِّمِ الْوَقْفِ وَالْوَكِيلِ لِأَنَّهُ نَائِبٌ عَنْهُمْ فَكَأَنَّهُ مُعَبِّرٌ.
