(وَكَذَلِكَ إِنِ اسْتَأْجَرَ دَابَّةً لِلسَّفَرِ فَبَدَا لَهُ. تُفْسَخُ الْإِجَارَةُ) لِأَنَّهُ يَلْزَمُهُ الضَّرَرُ بِالْمُضِيِّ عَلَى الْعَقْدِ؛ لِأَنَّهُ رُبَّمَا أَرَادَ التِّجَارَةَ فَأَفْلَسَ، أَوْ لِطَلَبِ غَرِيمٍ فَحَضَرَ.
