قَالَ: (وَتُعْتَبَرُ الْقِيمَةُ يَوْمَ الْقَبْضِ) لِأَنَّهُ يَوْمَئِذٍ دَخَلَ فِي ضَمَانِهِ وَفِيهِ يَثْبُتُ الِاسْتِيفَاءُ يَدًا ثُمَّ يَتَقَرَّرُ بِالْهَلَاكِ،

وَلَوِ اخْتَلَفَا فِي الْقِيمَةِ، فَالْقَوْلُ لِلْمُرْتَهِنِ لِأَنَّهُ يُنْكِرُ الزِّيَادَةَ، وَالْبَيِّنَةُ لِلرَّاهِنِ لِأَنَّهُ يُثْبِتُهَا.
