قَالَ: (وَلَا يَسْتَخْلِفُ عَلَى الْقَضَاءِ إِلَّا أَنْ يُفَوَّضَ إِلَيْهِ ذَلِكَ) لِأَنَّهُ كَالْوَكِيلِ عَنِ الْإِمَامِ ; وَالْوَكِيلُ لَيْسَ لَهُ أَنْ يُوَكِّلَ إِلَّا أَنْ يُؤْذَنَ لَهُ.
