وإن مات السيد قبل الأداء عتق بالتدبير إن حمل الثلث ما بقي عليه من كتابته، وإلا عتق منه بمقدار الثلث، وسقط من الكتابة بمقدار ما عتق، وكان على الكتابة فيما بقي.
