فَلَوْ شَرَطَا زِيَادَةً لِأَحَدِهِمَا لَمْ يَصِحَّ لِأَنَّهُ شَرْطُ عِوَضٍ مِنْ غير معوض " أو " أعاده " أحدهما " بنقضه وبآلة نَفْسِهِ لِيَكُونَ لِلْآخِرِ فِيمَا أُعِيدَ بِهَا جُزْءٌ
