" وَلَا يُطَالَبُ كَفِيلٌ بِمَالٍ " وَلَا عُقُوبَةٍ كَمَا فُهِمَ بِالْأَوْلَى وَإِنْ فات التسليم بموت أو غيره لأنه لم يلتزمه وَهَذَا أَعَمُّ وَأَوْلَى مِنْ قَوْلِهِ إذَا مَاتَ وَدُفِنَ لَا يُطَالَبُ الْكَفِيلُ بِالْمَالِ
