" وَلَا يَصِحَّانِ " أَيْ الضَّمَانُ وَالْكَفَالَةُ " بِشَرْطِ بَرَاءَةِ أَصِيلٍ " لِمُخَالَفَتِهِ مُقْتَضَاهُمَا وَالتَّصْرِيحُ بِالثَّانِيَةِ مِنْ زِيَادَتِي " وَلَا بِتَعْلِيقٍ " نَحْوُ إذَا جَاءَ الْغَدُ فَقَدْ ضَمِنْتُ مَا عَلَى فُلَانٍ أَوْ كفلت بدنه
